Arrested for a DUI, What's Next?

At the time of your arrest or citation the police officer may have taken your driver's license and given you a pink temporary license. This temporary license allows you to drive for 30 days. You must request a DMV Administrative Per Se Hearing and you must contact the DMV within 10 days. If you do not contact the DMV within the 10 days you will lose your right to have a hearing and your license will be automatically suspended 30 days after the DUI.

If this is your first DUI you face a suspension of your driver's license for four to six months. If your blood alcohol level was high or you refused a chemical test, your license may be suspended for even longer. In many cases after the first 30 days of suspension you may be eligible to apply for a restricted license.

Criminal Consequences of a DUI

If this is your first DUI you may be faced with jail time. The amount of jail time in your case will depend on the circumstances of your individual case. The minimum is usually 2 days and the maximum is 6 months. In addition to jail you may face fines, probation and DUI classes.

If this is your second, third or fourth DUI, you may face even more severe penalties, including up to one year in jail or prison time. If you are facing significant jail time we may be able to get you day-for-day credit for any time spent in a residential treatment program.
