Generally, cannabis possession, sales, transportation and cultivation are illegal in California. Possession of less than 1 ounce is an infraction subject to a fine of $100. Possession of more than 1 ounce is punishable as a misdemeanor with a maximum penalty of up to six months in jail and a $500 fine.

Additionally, unlawfully possessing marijuana for purpose of sale is a felony punishable by 16 months to three years in a state prison. The same is true for the charge of unlawful cultivation. Transportation of cannabis is punishable as a felony, which could mean two to four years in a state prison.

Oftentimes, these charges are combined, which drastically increases the fine and/or sentence.
